    A man who raped a schoolgirl while on the run from prison has had his minimum sentenced halved by appeal judges.

    Robert Foye was jailed for a minimum of nine years over the attack on the 16-year-old in August 2007.

    However, minimum sentencing guidelines were changed following successful appeals earlier this year by Foye and paedophile Morris Petch.

    Under new guidelines for discretionary life sentences, Foye, 32, will serve a minimum of four-and-a-half years.

    * joke! British justice system is a riot. They put all this effort in to these anti sectarian coppers and all the hype with football but when it comes to real criminals who do horrible and unforgivable things they pussyfoot around them.

    And when this sub human gets out and commits a crime again,don't charge him.....CHARGE THE IDIOT JUDGE! They make these wonderful rulings and never face the music on their rulings. The judges who do this are as guilty as the perp!

    I wouldn't be surprised if a group of people start to issue public justice to these scumbags. Fair enough they get a jail term, but think of the social prison the victim lives in. * kill all the evil little *, the government are just as much to blame, due to civil rights there is no such thing as tough punishment. If you can't act like a civil human being then you have no rights at all? Scumbags

    AND when they do prosecute someone for a sectarian offense they let hun jurys set them off!

    I do not believe in bringing death penalty back tho, as bad as our CJS is, killing people never made, and won't make anything any better, as good an idea as it may seem.

    How can it be possible for a RAPIST to only get 4 1/2 years?
    it's sickening and acts as no deterant or punishment. In fact it's a huge slap in the victims face. SHe gets a life sentance, so should that rapist scum

    A mother who drowned her daughter after attending the birth of her lover's baby to another woman has been jailed for five and a half years.

    Rachel Cowley, 43, of Shenval, Glenurquhart, cut the baby's umbilical cord at Raigmore Hospital in February.

    She then walked off with her own child, Isabelle, and drowned her in a burn.

    Cowley was due to be sentenced on Wednesday but she refused to leave a psychiatric clinic with security staff tasked with taking her to court.

    At the High Court in Edinburgh, judge Lord Bannatyne told Cowley that what had happened was "a dreadful tragedy" and she had deprived her daughter of her life at "such an early age".

    He told her he would have jailed her for eight years for the killing, but it would be reduced following her guilty plea.

    Lord Bannatyne also ordered that Cowley should be kept under supervision for a further four and a half when she can be returned to prison if she reoffends.

    The judge said he took into consideration a risk assessment, adding: "It states the risk of reoffending and causing harm is high and you present a real danger to any child of a future union."

    Lord Bannatyne said he understood Cowley had looked after Isabelle well and was "a loving and caring parent" but it was a very serious offence.

    Cowley pleaded guilty to culpable homicide in July.

    She was charged with murder, but the Crown accepted her plea to the reduced charge on the basis of diminished responsibility.

    'Alternative lifestyle'
    The court heard in July that Cowley and Nicola Charles, 26, were both in a relationship with Christopher Everitt, who fathered the children of both women.

    Advocate depute Alex Prentice QC told the court that in his view, given the accused's personality, "the domestic situation was untenable".

    Cowley, a first offender, admitted killing Isabelle, four, by forcing her head under water and causing her to drown during an attack in the grounds of Raigmore Hospital.

    The court heard that Cowley - who has a three-year-old son - and Mr Everitt had lived an alternative lifestyle. Over time a sexual relationship developed which involved the pair and Ms Charles.

    After Ms Charles fell pregnant she chose Cowley and Mr Everitt as her birthing partners.

    Following the birth, Cowley held the baby and a midwife noticed she seemed tense during a discussion about registering the child.

    Cowley later left the ward with Isabelle.

    She later appeared at a couple's home in Balloch, near Inverness, in the early hours of 23 February seeking help and claiming she was lost.

    Cowley was wearing a boiler suit she had taken from a skip at the hospital.

    She ran off when the police were called, but was traced by officers.

    The court heard that police asked Cowley if she had hurt the girl.

    She said: "I think I might have done something to her. I think she might be hurt."

    Mr Prentice said psychiatrists who examined Cowley were of the opinion that she was suffering from a mental disorder, most probably a personality disorder.

    The Northern Constabulary officer who led the police investigation into Isabelle's death said it was a tragic case.

    Det Insp Brian Mackay said: "We note the sentence handed to Rachael Cowley for the culpable homicide of her four year old daughter Isbabelle, whose young life was tragically caught short in February this year.

    "This was a tragic case in every sense which shocked the community and devastated the families concerned.

    "Our thoughts are with them at this extremely difficult time."
