    A few years ago I met a guy who said he knew the girls family, and supposedly she was killed by her younger brother who has learning difficulties or something.

    Watched a video today on youtube, well some of it. A lot of strange stuff. I can see why folk think he's innocent now. Looks like police had him charged then didn't want to backtrack and make themselves look bad.

    On the fence now.

    My instinct tells me innocent, same as the Amanda Knox situation (I read her book and it was enlightening.... also the Netflix documentary shows clearly the hatchet job attitude from that judge guy).

    The fact he was of alternative style probably went a long way in getting the public to go along with the narrative.

    Aye, he's excruciating to listen to. A skilled interviewer gets the subject to open up then allows them to talk, that James English keeps agreeing, interrupting or inputting his own take on things that ends up slanting the direction of the conversation. Also what's with that fake tan? :52:

    Well their is the best evidence candom with dna on it problem is doesn't match anyone on the database either that or police didn't bother to check or go around collecting dna off other suspects

    Regardless of innocence or guilt, this case was a prime example of being tried and found guilty by the red top rags, especially the Daily Record.

    At the time, every lawyer I know (three in the family for starters) said that on the evidence presented there was a clear “reasonable doubt” and he couldn’t possibly be convicted.

    The problem is a jury of ones peers will include thick people, really thick people. Selfish people who have had enough and just want to go home and, on occasion, a guy who has just seen 12 Angry Men and he will want to spin it out.

    It would fill me with horror if I ever faced a jury of my peers in Scotland. The low level of intelligence in this country is staggering, the tendency to still believe the editorial garbage in the media is astonishing. I’d want a trial going toe to toe with the Masonic wig wearing spankers on my own, never with a run of the mill everyday set of Scottish potatoes.

    Luke Mitchell may be guilty but he was found guilty by the police and media before his trial. There is no way the jury were not influenced by this.

    Channel 5 doing a 2 part documentary on this next week.
    I’ve been doing a bit of reading on this case and I’m amazed he was convicted given the lack of evidence against him.
    There does also seem to be quite a few other legitimate suspects that were never properly investigated.
    Difficult to say he’s definitely innocent but the media coverage at the time was absolutely disgraceful.

    I saw this come up and I couldn’t believe my post from 20 months ago was the last one till yours.

    I remember vividly that he was found guilty in the press before his trial and there is no way on earth the jury was not influenced by the media.

    He may still have done it, but the evidence was poor and bent to suit the only narrative.

    Reasonable doubt in abundance. At the very least the peculiar Scottish verdict of Not Proven should have been the outcome.

    I dont really know about the semantics of this particular case and the finer detail but I totally agree that I would hate to be tried by a jury after sitting on one.

    Half the folk on it you wouldn't have trusted to work out how to put shoes on without lettering them.

    I went to school with him and was born in the town the murder took place. I remember at the time it was thought to be a dead cert he done it but in years since I’ve heard a lot of things that do cast doubt. I still sway towards him being guilty but there is definitely holes in the case. Interested to see this documentary.

    Trial by media! Not like them to get it wrong now is it???

    The amount of circumstantial evidence that convicted him was worrying. That boy has spent most of his * life in prison for a crime that in this day and age wouldn't convict anyone. He has always maintained his innocence too.

    Pretty heavy watching this documentary as like many I took his guilt for granted, maybe that's not the case.
